1. Definitions

- Operator — NextGuard, the company providing the Service.
- User — an individual who has accepted these Terms and uses the Service.
- Subscription — a paid access period according to the selected plan.
- Config / Access Key — a configuration file or connection string issued by the Operator.
2. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between you and the Operator. By creating an account, making a payment, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
3. Service Description
The Operator provides:
- An encrypted secure data channel between the User's device and the Service infrastructure.
- DNS query protection against interception and leaks.
- Issuance and management of access keys (configs).
- Technical support per the selected plan.
- Automated connection monitoring and config rotation when instability is detected (Premium plans).
The Service is provided for personal, non-commercial use unless otherwise agreed in writing.
4. Account and Registration
The agreement is deemed concluded upon the User's payment of a Subscription or commencement of use of a free tier (if available). Registration is completed via Telegram bot or the website form. You agree to provide accurate information and keep it up to date.
5. Pricing and Payment
Current plans and prices are listed at nextguard.top in the "Pricing" section. Payment is due in full in advance for the chosen period. The Operator may change prices with at least 7 days' prior notice. Price changes do not apply to already-paid periods.
6. User Rights and Obligations
You are entitled to:
- Use the Service according to your selected plan.
- Contact support for service-related issues.
- Request a refund under the Refund Policy.
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law.
- Share access keys with third parties (unless permitted by your plan).
- Attempt to hack, overload, or otherwise improperly interfere with the Service infrastructure.
- Use the Service for spam, malware distribution, or attacks on third parties.
- Use the Service for fraud, illegal trade, or any criminal activity.
- Reverse-engineer, decompile, or attempt to extract source code of the Service.
7. Operator Rights and Obligations
The Operator is entitled to:
- Suspend or terminate access for violation of these Terms without refund.
- Perform scheduled maintenance with prior notice.
- Update these Terms as set out in Section 11.
The Operator commits to:
- Maintain Service availability of at least 99% per month (excluding scheduled maintenance).
- Respond to support requests within the timeframes specified in the plan.
- Store User personal data in accordance with the Privacy Policy.

9. Limitation of Liability
The Service is provided "as is". The Operator is not liable for:

- Indirect, incidental, or consequential damages arising from use or inability to use the Service.
- Actions or content of third parties accessible via the Service.
The Operator's total liability for any claims related to the Service is limited to the amount actually paid by the User for the most recent billing period.
10. Intellectual Property
All rights to software, technology, trademarks, logos, and other intellectual property related to the Service belong to the Operator or are licensed to it. These Terms do not grant the User any rights to the Operator's intellectual property beyond the right to use the Service as described herein.
11. Changes to Terms
The Operator may unilaterally amend these Terms. New versions take effect 7 days after publication on the website. Continued use of the Service after that date constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate the contract and request a refund for the unused period.
12. Termination
You may stop using the Service at any time by notifying support. The Operator may immediately terminate access for violation of these Terms, without refund of paid amounts.
13. Governing Law and Disputes
These Terms are governed by applicable international private law. Disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the competent court at the Operator's place of business. A mandatory pre-trial claims procedure applies; the Operator will respond to claims within 30 days.

Refund Policy

1. Overview
This Refund Policy describes the conditions under which Users may request a refund of paid amounts and how such requests are processed. This Policy forms part of the Terms of Service and Privacy Policy of NextGuard.
2. Money-Back Guarantee for Subscribers
NextGuard offers a 7-day money-back guarantee for Users making their Subscription payment. If within the 7 calendar days from the date of payment you are unsatisfied with the Service for any reason, you may request a full refund — no questions asked.
3. Conditions for Refund Eligibility
A refund will be issued when all of the following conditions are met simultaneously:
- No more than 7 calendar days have passed since the payment.
- Traffic used does not exceed 10% of the plan allowance.
- The request is submitted via an official support channel (Telegram or email).
- You have not violated the Terms of Service.
4. Partial Refund for Service Failures
If the Operator fails to maintain the guaranteed SLA level and the issue is not resolved within a reasonable time, you may request compensation. Following verification, the Operator will offer:
- Subscription extension for the confirmed downtime period; or
- A proportional partial refund for the period of unavailability.
5. Non-Refundable Cases
- More than 7 calendar days have passed since the payment.
- More than 10% of the plan's traffic has been used.
- Access was terminated due to a Terms of Service violation.
- The issue is caused by circumstances beyond the Operator's control (User-side ISP restrictions, User's device incompatibility).
6. How to Request a Refund

- Reason for the request (optional, but helps us improve).
Step 3. The processing time for your request is 1 business day. The refund will be issued to the same payment details used for the original transaction. The refund period is 5 business days from the moment of confirmation (the actual crediting depends on the payment provider and may take up to 14 days).
7. Subscription Cancellation Without Refund
You may cancel auto-renewal at any time by contacting support. Access to the Service continues until the end of the paid period. No refund is issued for the remaining period unless the conditions of Section 2 are met.
